DEDICATION OF FAIRWAY DRIVE
Acceptance of Dedication of Fairway Drive for public road into the City Street System from West End Investments, a General Partnership
Adopt a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHINO HILLS ACCEPTING FAIRWAY DRIVE INTO THE CITY STREET SYSTEM PURSUANT TO STREETS AND HIGHWAY CODE SECTION § 1806
West End Investments was the owner of what is now known as the property adjacent to Western Hills Golf Course and Country Club, between Carbon Canyon Road and the Southerly boundary of Western Hills Estates mobile home park. In 1987, West End Investments irrevocably offered to dedicate to the County of San Bernardino and the Public in General, an easement for public road, county highway and public utility purposes over what is commonly known as Fairway Drive, adjacent to and Easterly of the golf course. The offer was recorded on January 16, 1987, but was never formally accepted by the County into the publicly maintained roadway system.
At the City Council’s meeting of November 28, 2000, the Council authorized execution of Agreement Nos. A00-159 and A00-159A between the City of Chino Hills and West Hills Golf Associates, Ltd., which provided that the City would accept Fairway Drive into the City maintained street system. In addition to the acceptance of Fairway Drive were other improvements to the golf course parking lot, and some curb and concrete v-gutter improvements to Fairway Drive, all performed by the City at no cost to the golf course. These were done in exchange for a 1.2 acre parcel of land given to the City for Western Hills Park at Carbon Canyon Road and Cannon Lane. A final condition in the agreement was the granting of two waterline easements to the City for a 12-inch diameter water pipeline and two 16-inch diameter water pipelines that cross the golf course property. These easements were recorded in early January 2001. This is explained in the City Council staff report from November 28, 2000.
As a requirement of the 1972 Subdivision Map Act, all subdivided properties must have legal access to a publicly maintained street. Currently, Ausmas Properties is the owner of the property being subdivided as Tract No. 18393-1, which lies directly East and adjacent to Fairway Drive. The approval of that map is a subsequent agenda item for Council consideration.
Although the improvements and dedication requirements within the agreements were completed, the acceptance of Fairway Drive as a public street by the City was never finalized. Approval of this item will complete the City’s obligation under the agreements referenced above, and provide public access to all the adjacent properties. This includes the land currently being subdivided as Tract No. 18393-1, West Hills Golf Associates, Ltd. property, and Western Hills Estates mobile home park.
Staff is recommending approval of this item so the City’s past obligation can be met, and the final map for Tract No. 18393-1 can be found to be in conformance with the Subdivision Map Act relative to legal access to a publicly maintained road.
ENVIRONMENTAL (CEQA) REVIEW:
Acceptance of the offer of dedication of Fairway Drive does not change or alter existing conditions, as Fairway Drive is currently being maintained by the Public Works Department. This action is, therefore, not a project within the meaning of the CEQA Guidelines Section 15378 and is therefore exempt from CEQA as it will not result in any direct or indirect physical change in the environment and does not involve an irrevocable commitment of resources by the City of Chino Hills.
The acceptance of Fairway Drive into the publicly maintained roadway system of the City of Chino Hills will not have any measurable change in the total funds used for roadway maintenance because the City is already maintaining Fairway Drive.
