AMENDMENT NO. 4 TO AGREEMENT NO. A02-80 WITH T-MOBILE WEST LLC
Authorize the execution of Amendment No. 4 to Agreement No. A02-80 with T-Mobile West LLC, successor-in-interest to TMO CA/NV LLC f/k/a Pacific Bell Wireless, LLC hereinafter called "T-Mobile" to amend Attachment "D" to modify the telecommunications equipment of the existing cell facility at 3982 Eucalyptus Avenue (Monopine - Booster Station B-9).
The City entered into Agreement A02-80 with Cox Communications PCS, LP, on September 24, 2002. That agreement has been extended for successive five-year terms pursuant to the terms of the lease and is still in effect today. The Agreement was amended on January 14, 2014, June 28, 2016, and November 28, 2017 to amend mailing addresses, equipment modifications, add access restrictions and requirements, and to increase the deposit amount. The original Agreement and subsequent amendments are on file in City Clerk's office. On May 4, 2018, T-Mobile West, LLC submitted plans to replace its equipment at 3982 Eucalyptus Avenue Booster Station (B-9) with new equipment. The Community Development Department approved the plans to install one new additional Air32 Panel antenna and new 6x12 Hybrid Cable, relocate a single antenna, and reorient three antennas on the existing monopine. Attachment "D" is an accurate description of the new equipment to be installed.
ENVIRONMENTAL (CEQA) REVIEW:
This proposed action is exempt from review under the California Environmental Quality Act (California Public Resources Code §§ 21000 et seq.,
) and CEQA regulations (14 California Code Regulations §§ 15000 et seq.) because it constitutes an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. Accordingly, this action does not constitute a "project" that requires environmental review (see specifically 14 CCR § 15378 (b)(4-5)).
The amendment to the agreement will have no fiscal impact on the General Fund except to continue the revenue generated from the lease. Any costs incurred in the preparation and review of the agreement, including attorneys' fees, will be deducted from the deposit collected by the City.
