SUBJECT:
TRACT MAP NO. 18393-1 (AUSMAS PROPERTIES), LOCATED NORTH OF CARBON CANYON ROAD, ADJACENT TO WESTERN HILLS GOLF COURSE AND COUNTRY CLUB AND SOUTH OF WESTERN HILLS ESTATES MOBILE HOME PARK.
RECOMMENDATION:
  1. Pursuant to Gov. Code, § 66456.1, the City Council find, in concurrence with the subdivider, that the final map for Tract No. 18393-1 can be filed in two phases, subject to the conditions set forth in Exhibit A, incorporated by this reference, attached.
     
  2. Pursuant to Gov. Code, § 66458 (a), the City Council approve and accept the Final Map of Tract No. 18393-1, with the implementation of the conditions set forth in Exhibit A, as it conforms to all the requirements of the Subdivision Map Act and the City’s Subdivision Map ordinance  applicable at the time of conditional approval of the tentative map. 
     
  3. The City Council direct the City Clerk not to record the Final Map of Tract No. 18393-1 until the conditions listed on Exhibit A that must be completed prior to recordation are completed as determined by the City Manager. 
     
  4. Approve and authorize execution of the Monumentation Agreement and the Subdivision Improvement Agreement, incorporated by this reference, attached. 
     
  5. Accept a deposit to guarantee setting of the final monuments for Tract No. 18393-1 in the amount of $22,800. 
     
  6. Authorize acceptance of the following improvement securities, attached:

  1. Authorize the City Clerk to cause Tract Map No. 18393-1 to be recorded pursuant to Item 3 above.
     
BACKGROUND/ANALYSIS:
In September 2006, Stonefield Development submitted Tentative Tract Map (TTM) No. 18393 to subdivide vacant land located on the northwest side of Carbon Canyon Road and east of Fairway Drive for the development of 28 single-family homes. On October 27, 2009, the City Council of the City of Chino Hills adopted resolutions approving TTM No. 18393, Design Review No. 336, and Minor Variance No. 09MV01.  An Environmental Impact Report, Statement of Overriding Considerations, and Mitigation Monitoring and Reporting Program for the project was also approved.
 
The tentative tract map subdivides the existing 34.73-acre property into 28 single-family residential lots and 14 lots for open space with private streets for access purposes. To facilitate the development of the project, the owner of the property, Ausmas Properties, is proposing to develop the project in two phases. The first phase, Tract Map No. 18393-1, consists of three residential lots and four lettered lots.  It is assumed that subsequent phases will subdivide the remaining site.
 
The applicant has completed the Final Map review process and all applicable conditions have been met as recommended by the corresponding departments of the City of Chino Hills. With the acceptance of the Tract Map and the payment of the taxes, the map will be recorded. City Council approval is required pursuant to Section 66458 of the Subdivision Map Act.

Pursuant to the provisions of Section 66456.1 (b) of the Subdivision Map Act, “multiple final maps relating to an approved or conditionally approved tentative map can be filed prior to the expiration of the final map if, after filing of the tentative map, the local agency and the subdivider concur in the filing of multiple final maps. 
 
Staff has reviewed the Conditions of Approval that were approved for the full development, and have included a matrix addressing each of the conditions that must be satisfied prior to the recordation of this Phase One final map.  This matrix has been included herewith as an attachment.  Additionally, pursuant to Section 66456.1 (b) of the Subdivision Map Act, the City may impose reasonable conditions relating to the filing of multiple final maps.  Staff recommends the imposition of the additional Conditions of Approval for the phased maps as provided in the attached document. As discussed in the attached matrix, staff finds that the phase one final map substantially complies with the Conditions of Approval.
ENVIRONMENTAL (CEQA) REVIEW:

An Environmental Impact Report (EIR), including a Mitigation Monitoring and Reporting Program was prepared and adopted for the project on October 27, 2009, pursuant to the California Environmental Quality Act (CEQA) Guidelines and the City of Chino Hills Local Procedures for implementing CEQA.  This action of approving the Final Map is a ministerial action not subject to CEQA and is, regardless, a necessary action included within the scope of the EIR referenced above.

FISCAL IMPACT:
There is no fiscal impact associated with this agenda item.
