SUBJECT:
NOTICE OF COMPLETION FOR CONSTRUCTION OF THE LOS SERRANOS INFRASTRUCTURE IMPROVEMENTS - SAFE ROUTES TO SCHOOLS PHASE 3 (SRTS 3) PROJECT BY CALIFORNIA LANDSCAPE AND DESIGN, INC.
RECOMMENDATION:
  1. Accept the Los Serranos Infrastructure Improvements - Safe Routes to School Phase 3 (SRTS 3) Project by California Landscape and Design, Inc. as complete.
     
  2. Authorize the City Clerk to cause the Notice of Completion to be recorded.
     
  3. Authorize the release of retention monies in the amount of $40,665.68, forty-five days after acceptance of the work by the City Council.
     
  4. Authorize the release of any remaining encumbrance after final payment of retention.
     
  5. Reduce the amount of the Performance Bond down to 15% for warranty purposes for a period of one year.
     
  6. Authorize the release of the Labor and Materials Bond six months after project acceptance.
BACKGROUND/ANALYSIS:
On March 14, 2017, the City Council awarded a contract to California Landscape and Design, Inc. in the amount of $828,000 for the Los Serranos Infrastructure Improvements - Safe Routes to Schools Phase 3 (SRTS 3) Project.  The Council also provided authorization for the City Manager to approve change orders up to a cumulative amount of $82,800 or 10% of the contract amount.  Construction began on April 3, 2017, and was substantially complete on December 1, 2017. 

Due to changes in the field conditions of the existing improvements, and the corresponding asphalt repairs that were necessary, additions and deductions to various work items became necessary. On November 2, 2017, Change Order No. 1 was approved by the City Manager, increasing the contract amount by $29,338.86, and on May 4, 2018, Change Order No. 2 was also approved by the City Manager for a $44,025.30 credit.  Consequently, the original contract amount of $828,000 has been reduced to $813,313.56, a 1.8% savings.  All work has been completed satisfactorily and staff is asking that the Notice of Completion be filed with the County Recorder’s office.
 
ENVIRONMENTAL (CEQA) REVIEW:
At the March 22, 2005, City Council meeting, the project was determined to be exempt as a Class 1(c) Categorical Exemption, (existing highway and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities), pursuant to Section 15301 of Guidelines for the California Environmental Quality Act of 1970, as amended, Public Resources Code Section 21000 et seq.
 
The project received a NEPA environmental determination (Categorical Exemption) through Caltrans on July 9, 2015.
FISCAL IMPACT:
There will be no impact to the General Fund.  Funds for the Los Serranos Infrastructure Improvements - Safe Routes to Schools Phase 3 (SRTS 3) Project were previously approved by the City Council as part of the Fiscal Year 2017/18 Capital Improvement Program (CIP) budget.
