SUBJECT:
PARCEL MAP NO. 19502 (CHINO HILLS COMMERCE CENTER) LOCATED AT THE CORNER OF RED BARN COURT AND FAIRFIELD RANCH ROAD
RECOMMENDATION:
 
1.  Approve and authorize execution of the Site Improvement Agreement.
 
2.  Authorize acceptance of the following improvement securities:

BACKGROUND/ANALYSIS:
On September 22, 2015, the City Council approved a Professional Services Agreement with Rincon Consultants, Inc. to prepare an Initial Study and other related technical studies for what was then known as the Indus Project on the northerly side of Red Barn Court at Fairfield Ranch Road.  The project included the development of a 100,300-square-foot warehouse building on a vacant site.  The cost of these services was borne by the proponents of this development.
 
On August 2, 2016, the Chino Hills Planning Commission adopted the Mitigated Negative Declaration (MND) and Mitigation Monitoring Measures associated with this development, and approved Site Plan 15SPR01 allowing development of the proposed building on a 4.87-acre vacant site.  The applicant was Newcastle Partners and the owner was Indus-Chino Hills LP.  Since that time, the applicant has changed to HGN Chino Hills, LLC.
 
On September 13, 2016, the City Council adopted Resolution No. 2016R-041 approving Site Plan 15SPR01, along with Conditions of Approval requiring installation of certain  public street improvements on Red Barn Court and Fairfield Ranch Road.  The plans for these improvements have now been reviewed and approved by the Engineering Division of the Public Works Department.
 
The applicant’s engineer has prepared an improvement cost estimate and they have submitted Improvement Bonds covering this work as previously noted.

ENVIRONMENTAL (CEQA) REVIEW:
This action approving the Site Improvement Agreement and the bonds is not a project within the meaning of the California Environmental Quality Act (California Public Resources Code  21000, et seq., “CEQA”) pursuant to CEQA Guidelines (Title 14 California Code of Regulations  15000, et seq.) Section 15378 and is not subject to review under CEQA.  Further, these actions are necessarily included action element of the projects considered in the MND adopted on August 2, 2016 by the Planning Commission, which adequately addressed the effects of the proposed project. No substantial changes have been made in the project, no substantial changes in the circumstances under which the project is being undertaken and no new information of substantial importance to the project which was not known or could not have been known when the MND was adopted have become known. Therefore, no further environmental review is required.
FISCAL IMPACT:
There is no fiscal impact associated with this agenda item.
