SUBJECT:
AMENDMENT NO. 1 TO AGREEMENT A2017-187 WITH LG2WB ENGINEERS, INC. (LLG)
RECOMMENDATION:
Authorize the execution of Amendment No. 1 to Agreement No. A2017-187 with LG2WB Engineers, Inc. to increase the not-to-exceed amount of $25,850 by $3,500 for a revised total of $29,350.
BACKGROUND/ANALYSIS:
On October 13, 2015, Council authorized the execution of an agreement with The Chambers Group to prepare an initial study and related technical studies for the Rincon project, formally known as the Golden Triangle Project. The related technical studies included a traffic study for the project. The studies were prepared and the Planning Commission approved the project in October 2016. The initial project consisted of the approval to develop approximately 60,000 square feet of hotel, 60,000 square feet of medical, 20,475 square feet of retail, and 16,625 square feet of restaurant. The approved site plan lists a total of six (6) buildings.

Following that approval, the applicant proposed substantial changes to the approved site plan requiring additional traffic analysis. On August 8, 2017, Council authorized the execution of an agreement with LLG for a new traffic study in the amount $25,850.  During the preparation of the new traffic study, the applicant made additional changes to the site plan. The additional changes resulted in a change to the scope of work and increased the not-to-exceed amount by $3,500 for a revised total of $29,350.
ENVIRONMENTAL (CEQA) REVIEW:
This action of approving is not a project within the meaning of the California Environmental Quality Act (California Public Resources Code §§ 21000, et seq., “CEQA”) and CEQA Guidelines (Title 14 California Code of Regulations §§ 15000, et seq.) Section 15378 and is therefore exempt from CEQA.  It will not result in any direct or indirect physical change in the environment because it is only a preliminary action required in order to study the proposed project.  
FISCAL IMPACT:
There is sufficient funding in the TDA Pass Thru Fund budget to cover the Fiscal Year 2017/18 cost of the LLG contract.  Future contract costs will be budgeted for in the appropriate fiscal year.  All costs for this contract will be reimbursed by the developer and there is no impact on the General Fund.
