SUBJECT:
AMENDMENT NO. 3 TO AGREEMENT NO. A12-05 WITH MICHAEL BAKER INTERNATIONAL, INC.
 
RECOMMENDATION:
Approve Amendment No. 3 to Agreement No. A12-05 with Michael Baker International, Inc., extending the contract term to June 30, 2019.
BACKGROUND/ANALYSIS:
On February 28, 2012, the City Council approved a Professional Services Agreement with RBF, Inc., now Michael Baker International, Inc. (Amendment No. 1), for planning and design services of an above-ground, 5 million gallon (MG) steel tank reservoir, R18, in Carbon Canyon.  On June 14, 2016, the City Council approved Amendment No. 1 changing the company name from RBF to Michael Baker International, Inc. and extending the contract term to June 30, 2017.  On January 10, 2017, the City Council approved Amendment No. 2 for additional work for the reservoir elevation verification surveys, additional retaining wall design, drainage discharge design alternatives, and preparation of a Water Quality Management Plan (WQMP).
 
During the survey work it was found that the floor elevations of the project’s interconnected reservoirs were much higher than the project elevation floor thus resulting in approximately 1.3 MG of unusable space.  Staff directed Michael Baker to redesign the tank’s structure to reduce the unusable water volume and reduce the construction cost.  The tank’s alterations required changes in grading and a review of the geotechnical project site. The need for this review extended the project’s schedule for an additional month beyond June 30, 2017.
 
Staff is requesting that the City Council authorize Amendment No. 3 to extend Agreement No. A12-05 with Michael Baker International, Inc. to June 30, 2019.  This will enable them to complete the project design and to act as an on-call advisor during the construction phase.
ENVIRONMENTAL (CEQA) REVIEW:
This action is not a project within the meaning of the CEQA Guidelines Section 15278 and is; therefore, exempt from CEQA as it is an administrative change that will not result in any direct or indirect physical change in the environment.
FISCAL IMPACT:
There is no fiscal impact.  Funding for these services is part of the reservoir R18 project, part of the proposed FY 2017-18 Capital Improvement Program budget.
