SUBJECT:
AMENDMENT NO.1 TO AGREEMENT A2017-041 WITH BABCOCK LABORATORIES, INC. FOR WATER QUALITY ANALYSES
RECOMMENDATION:
Authorize execution of Amendment No. 1 to Agreement No. A2017-041 with Babcock Laboratories Inc., for an annual not-to-exceed amount of $35,000, for water quality analysis and extend the term to June 30, 2019.
BACKGROUND/ANALYSIS:
The City is required, under Title 22 of the Safe Water Drinking Act, to perform periodic sampling of domestic water and, under the Clean Water Act, also test storm water samples. A Request for Proposal (RFP) was solicited and several proposals were received on April 21, 2016. Three proposals were evaluated and rated on their approach to work, references, experience, technical competence and fees. Of the three proposals, Babcock Laboratories and Weck Laboratories rated the highest.
 
On June 28, 2016, Council approved a three-year agreement with Weck Laboratories for an annual not-to-exceed amount of $35,000. Once the services initiated, staff determined Weck was not able to provide all needed analyses services, however, Babcock Laboratories does provide the needed services.
 
On February 23, 2017, the City entered into Agreement No. A2017-041 with Babcock Laboratories, Inc., for a not-to-exceed amount of $15,000 to provide water quality analysis of domestic and storm water samples through the end of the fiscal year. Since Babcock offers the services needed, staff is requesting Amendment No. 1 to increase the annual amount from $15,000 to $35,000 and extend the term of the agreement.
ENVIRONMENTAL (CEQA) REVIEW:
This action is not a project within the meaning of the California Environmental Quality Act (California Public Resources Code § 21000, et seq., “CEQA”) and CEQA Guidelines (Title 14 California Code of Regulations § 15000, et seq.) Section 15378 and is therefore exempt from CEQA.  It will not result in any direct or indirect physical change in the environment as it is solely an administrative action, which allows for the analysis of domestic and stormwater samples.
FISCAL IMPACT:
Funding for the work performed under this agreement is in the proposed Fiscal Year 2017/18 Water Production and Storm System Maintenance budgets.
