SUBJECT:
AMENDMENT NO. 4 TO AGREEMENT NO. A2016-114 WITH MICHAEL BAKER INTERNATIONAL, INC.
RECOMMENDATION:
Authorize the execution of Amendment No. 4 to Agreement No. A2016-114 with Michael Baker International, Inc., increasing the annual not-to-exceed amount from $250,000 to $310,000.
BACKGROUND/ANALYSIS:
On June 14, 2016, City Council authorized the execution of Agreement No. A2016-114 for advanced planning services with Michael Baker International, Inc. On June 13, 2017, City Council approved Amendment No. 1 to increase the contract by $50,000 for an annual not-to-exceed amount of $250,000. Amendment No. 2, approved by City Council on July 11, 2017, modified the scope of work to allow the Contract Senior Planner to work at City Hall or under the direction of the Community Development Director remotely from Michael Baker’s corporate office. Amendment No. 3, approved by City Council on June 9, 2020, increased the hourly rate from $120/hour to $160/hour and extended the contract term to June 30, 2021, with a one-year renewal option.  After evaluation of current personnel commitments and the increase of required Contract Senior Planner hours required due to the complexity of several large-scale on-going projects, staff recommends to increase the Michael Baker International, Inc. contract amount by $60,000 for an annual not-to-exceed amount of $310,000.  It is expected that the $60,000 increase will be offset by developer deposits through Trust Deposit Accounts (TDAs).
ENVIRONMENTAL (CEQA) REVIEW:
This proposed action is exempt from review under the California Environmental Quality Act (California Public Resources Code §§ 21000, et seq., "CEQA") and CEQA Guidelines (Title 14 California Code of Regulations §§ 15000, et seq.), because it does not involve any commitment to a specific project which could result in a potentially significant physical impact on the environment; and, constitutes an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. Accordingly, this action does not constitute a "project" that requires environmental review (see specifically 14 CCR § 15378(b)(4-5)).
FISCAL IMPACT:
There is sufficient funding in the Development Services operating budget to cover the Fiscal Year 2020-21 cost of the Michael Baker International, Inc. agreement. Future contract costs will be budgeted for in the appropriate fiscal year.
