SUBJECT:
NOTICE OF COMPLETION - MYSTIC CANYON DRIVE PAVEMENT REHABILITATION PROJECT
 
RECOMMENDATION:
  1. Accept the Mystic Canyon Drive Pavement Rehabilitation project by Onyx Paving Company, Inc., as complete.
     
  2. Authorize the City Clerk to cause the Notice of Completion to be recorded.
     
  3. Authorize the release of retention monies in the amount of $19,325.08, forty-five days after acceptance of the work by the City Council.
     
  4. Authorize the release of any remaining encumbrance after final payment of retention.
     
  5. Reduce the amount of the Performance Bond to 15% for warranty purposes for a period of one year.
     
  6. Authorize the release of the Labor and Materials Bond seven months after project acceptance.
BACKGROUND/ANALYSIS:
On April 28, 2020, the City Council awarded a contract to Onyx Paving Company, Inc. in the amount of $437,000 for the Mystic Canyon Drive Pavement Rehabilitation project. The City Council also provided authorization for the City Manager to approve change orders up to a cumulative amount of $43,700, or 10% of the contract amount. Construction began on May 26, 2020 and was substantially completed on July 28, 2020. 
 
The work included full-width pavement asphalt grind and overlay, adjustment of utility manholes and water valves, ADA ramps, restoration of striping, and pavement legends and markers.
 
At the completion of the work, quantities estimated in the bid documents had to be adjusted to reflect the actual field measurements. The City Manager executed Change Order No. 1 which includes a complete list of all quantity adjustments, as well as additional items, all of which result in the final contract amount as follows:

ENVIRONMENTAL (CEQA) REVIEW:
At the February 11, 2020, City Council meeting, the project was determined to be exempt as a Class 1(c) Categorical Exemption, (existing highway and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities), pursuant to Section 15301 of Guidelines for the California Environmental Quality Act of 1970, as amended, Public Resources Code section 21000 et seq.
FISCAL IMPACT:
The total estimated cost for this project is as follows:

The current Capital Improvement Program has $956,400 budgeted for the Mystic Canyon Drive Pavement Rehabilitation project. There is no impact on the General Fund with this item. The funding available for this project is as follows:
