SUBJECT:
RESOLUTION CONFIRMING THE ENGINEER’S ANNUAL LEVY REPORT FOR CHINO HILLS LOS SERRANOS LIGHTING MAINTENANCE DISTRICT
RECOMMENDATION:

Adopt a resolution entitled:  A RESOLUTION OF THE CITY OF CHINO HILLS, ACTING IN ITS CAPACITY AS THE GOVERNING BODY OF THE CHINO HILLS LOS SERRANOS LIGHTING MAINTENANCE DISTRICT, TO CONFIRM THE ANNUAL ASSESSMENTS AND ORDER THE LEVY AND COLLECTION OF ASSESSMENTS FOR THE CHINO HILLS LOS SERRANOS LIGHTING MAINTENANCE DISTRICT, PURSUANT TO PROVISIONS OF THE LANDSCAPING AND LIGHTING ACT OF 1972 (STREETS AND HIGHWAYS CODE, SECTION 22500 ET SEQ.).

BACKGROUND/ANALYSIS:
The Chino Hills Los Serranos Lighting Maintenance District (District) was formed to provide street lighting to the neighborhood area known as Los Serranos. The street lighting services include, but are not limited to, the maintenance and operations costs of lighting fixtures and related appurtenant facilities associated with the public street lighting within the District as well as the costs of electrical energy.
 
Each fiscal year, the City reviews the phasing of construction within the Los Serranos District. Each of the phases is considered assessable in the fiscal year after which Council has awarded the construction contract for installation of the streetlights. Parcels that directly benefit from these improvements are assessed in the following year.  

Annually, the City Council must hold a public hearing to review the costs of operation for lighting as presented in the Engineer’s Annual Levy Report and to set the annual assessment rates within the District. On February 11, 2020, the City Council adopted Resolution No. 2020R-010 ordering the Engineer’s Annual Levy Report for fiscal year 2020/21. On May 27, 2020, the City Council set June 23, 2020 as the date for the public hearing. 

The assessment methodology set by the District allows an escalator based on the power company rate. For FY 2020/21, Southern California Edison raised the base electrical rate 5%, allowing the levy to increase from $57.76 to $58.08. This is the first levy increase since FY2018/19. The Engineer's Annual Levy Report for FY 2020/21, with proposed assessments and the District map, has been on file with the City Clerk's office since May 27, 2020.
 
 
ENVIRONMENTAL (CEQA) REVIEW:
The proposed project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Title 14 California Code of Regulations § 15301 (h) as a Class 1 Categorical Exemption (Existing Facilities). The project involves maintenance of existing lighting and is not anticipated to have any significant impacts with regard to traffic, noise, air quality, or water quality.
FISCAL IMPACT:
The total costs for the District are $27,184 and the proposed levy is $53,101.  This will result in a fund balance contribution of $25,917. There is no impact to the General Fund with this item.
