SUBJECT:
MAINTENANCE AGREEMENT WITH CALTRANS - GATEWAY MONUMENT ON CHINO HILLS PARKWAY
RECOMMENDATION:
  1. Adopt a Resolution entitled: RESOLUTION OF THE CITY OF CHINO HILLS, AUTHORIZING APPROVAL OF THE PROJECT SPECIFIC MAINTENANCE AGREEMENT FOR GATEWAY MONUMENT IN THE CITY OF CHINO HILLS (08-SBd-142-PM 5.6) BETWEEN THE STATE OF CALIFORNIA ACTING BY AND THROUGH THE CALIFORNIA DEPARTMENT OF TRANSPORTATION (CALTRANS).
     
  2. Authorize the execution of  the Project Specific Maintenance Agreement for Gateway Monument in the City of Chino Hills (08-SBd-142-PM 5.6) between the State acting by and through the California Department of Transportation (Caltrans) and the City of Chino Hills.
     
  3. Determine that the above actions are exempt from review under the California Environmental Quality Act of 1970, as amended, Public Resources Code Section 21080(b)(1) et seq. (“CEQA”) pursuant to Section 15268(a) of CEQA Guidelines.
BACKGROUND/ANALYSIS:
The City desires to create a streetscape designation that will enhance and establish a welcoming image and entrance into the community on Chino Hills Parkway (SR 142). Since this segment of Chino Hills Parkway is under the jurisdiction of Caltrans, staff follows the process mandated by Caltrans. 

The Gateway Monument was presented to the Public Works Commission on March 6, 2019. On April 10, 2020, Caltrans District 8 Director approved the City of Chino Hills Gateway Monument Proposal and Letter of Resolution acknowledging funding responsibility for construction and maintenance of the Gateway Monument within State roadway right-of-way throughout its projected life.
 
Prior to Caltrans issuance of an encroachment permit, the City is required to enter into a Project Specific Maintenance Agreement with Caltrans to identify maintenance responsibilities for the project. Staff will return to the City Council at a future meeting for approval of a construction contract.
ENVIRONMENTAL (CEQA) REVIEW:
The project has been determined exempt from review pursuant to Section 15268(a) Guidelines for the Environmental Quality Act of 1970, as amended, Public Resource Code Section 21080(b)(1) et seq.
FISCAL IMPACT:
There is no fiscal impact with this item. The Capital Improvement Program has $80,000 budgeted in Community Facilities District No. 5 for the Gateway Monument Project.
