Pursuant to Section 3 of Executive Order N-29-20, issued by Governor Newsom on March 17, 2020, the regular meeting of the Planning Commission for December 1, 2020 will be conducted remotely through Zoom. Please be advised that pursuant to the Executive Order, and to ensure the health and safety of the public by limiting human contact that could spread the COVID-19 virus, the Council Chambers will only be open to Commissioners and City staff and will not be open to the public for the meeting.

The City wants you to know that you can also submit your comments via email to PlanningCommission@chinohills.org.  To give the Planning Commission Secretary adequate time to print out your comments for consideration at the meeting, please submit your written comments prior to 5:30 p.m.; or if you are unable to email, please call the Community Development Department at (909) 364-2740 by 5:30 p.m.  Emails and documents submitted will be considered a public document subject to posting on the City's website. Similarly, email addresses of attendees are captured by the zoom software and are subject to the Public Records Act.
 
If you wish to have your comments read to the Commission during the appropriate Public Comment period, please indicate in the Subject Line "FOR PUBLIC COMMENT" and list the item number you wish to comment on. Comments that you want read to the Commission will be subject to the three minute time limitation (approximately 350 words).
 
Pursuant to the Executive Order, and in compliance with the Americans with Disabilities Act, if you need special assistance to participate in the Planning Commission meeting, please contact the Commission Secretary at (909) 364-2740 within 48 hours of the meeting.

PUBLIC COMMENTS:   At this time members of the public may address the Planning Commission regarding any items within the subject matter jurisdiction of the Planning Commission, whether or not the item appears on the agenda, except testimony on Public Hearing items must be provided during those hearings. Those persons wishing to address the Commission are requested to please raise your hand via Zoom or dial *9 to be selected from the meeting cue.  Comments will be limited to three minutes per speaker.
 
CONFLICT OF INTEREST / EX PARTE COMMUNICATION ANNOUNCEMENTS:  For conflicts of interest, Commissioner abstentions shall be stated at this time for recordation on the appropriate item.  For ex parte communications, Commissioners shall state their intent to report on any ex parte communications applicable to public hearings on the current agenda.

CONSENT ITEMS:   All matters listed on the Consent Calendar are considered routine by the Planning Commission and may be enacted by one motion in the form listed below. There will be no separate discussion of these items unless, before the Planning Commission votes on the motion to adopt, Members of the Planning Commission, staff or the public request the matter to be removed from the Consent Calendar for separate action. Removed consent items will be discussed immediately after the adoption of the balance of the Consent Calendar.

RECOMMENDED ACTION: Approve as submitted.

PUBLIC HEARINGS - This portion of the Planning Commission Agenda is for all matters that legally require an opportunity for public input. 7a. CONSIDERATION OF AND ACTION ON THE ORANGE COUNTY FLOOD CONTROL DISTRICT REQUEST FOR A DETERMINATION/REPORT PURSUANT TO GOVERNMENT CODE SECTION 65402(C) AS TO WHETHER THE PROPOSED ACQUISITION OF FLOWAGE AND INUNDATION EASEMENTS ON TWO CITY OF CHINO HILLS PROPERTIES CONFORMS WITH THE CHINO HILLS GENERAL PLAN

RECOMMENDED ACTION: Approve and adopt the following resolution:
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CHINO HILLS FINDING THAT THE LOCATION, PURPOSE AND EXTENT OF THE PROPOSED ACQUISITION OF FLOWAGE EASEMENTS BY THE ORANGE COUNTY FLOOD CONTROL DISTRICT (OCFCD) ON PROPERTIES OWNED BY THE CITY OF CHINO HILLS (KNOWN AS ASSESSOR PARCEL NO’S 1027-492-01 and 1027-531-48) IS IN CONFORMANCE WITH THE CITY OF CHINO HILLS GENERAL PLAN PURSUANT TO GOVERNMENT CODE SECTION 65402(C), AND FINDING THAT THE PROJECT IS EXEMPT FROM REVIEW UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT
 
All Planning Commission decisions may be appealed to the City Council.  An appeal of a Planning Commission decision must be filed with the City Clerk within ten (10) working days of the meeting. Please contact the City Clerk at (909) 364-2620 for further information about filing an appeal or obtaining an appeal application.
