This agenda contains a brief general description of each item to be considered. Except as otherwise provided by law, no action shall be taken on any item not appearing on the agenda unless the City Council makes a determination that an emergency exists or that a need to take immediate action on the item came to the attention of the City subsequent to the posting of the agenda. The City Clerk has on file copies of written documentation relating to each item of business on this Agenda available for public inspection in the Office of the City Clerk, in the public binder located at the entrance to the Council Chambers, and on the City's website at www.chinohills.org  while the meeting is in session. Materials related to an item on this Agenda submitted to the Council after distribution of the agenda packet are available for public inspection in the Office of the City Clerk at 14000 City Center Drive, Chino Hills, CA during normal business hours.

CONSENT CALENDAR ITEMS (15 ITEMS) - All matters listed on the Consent Calendar are considered routine by the City Council and may be enacted by one motion in the form listed below. There will be no separate discussion of these items unless, before the City Council votes on the motion to adopt, Members of the City Council or staff request the matter to be removed from the Consent Calendar for separate action. Removed consent items will be discussed immediately after the adoption of the balance of the Consent Calendar.
 
8.   Approve November 22, 2016 City Council Meeting Minutes
 
9.   Approve Warrant Registers for period of November 3 through 16, 2016 in amount of $2,547,975.03

12.   Adopt an Ordinance entitled: An Ordinance of the City Council of the City of Chino Hills, California, Amending Chapter 5.28 of the Chino Hills Municipal Code to prohibit all Commercial Marijuana Activity and finding exempt from review under the California Environmental Quality Act - Second Reading (Introduced November 22, 2016)
 
13.   Authorize execution of License Agreement with Chino Hills Youth Athletics Association for operation of concession stand at Chino Hills Community Park through December 31, 2017
 
14.   Authorize execution of Professional Services Agreement with Linscott, Law, and Greenspan, Engineers (LLG) dba LG2WB Engineers, Inc., in amount not-to-exceed $33,675 to provide traffic consulting services for Founders Village Project
 
15.   Authorize execution of Professional Services Agreement with Rincon Consultants, Inc., in amount not-to-exceed $37,301 to provide environmental consulting services for Founders Village Project
 
16.   Adopt resolution increasing deposits on utility bills and amending Administrative Policy for Utility Customer Service to clarify procedures for transfer of balances to another utility account
 
17.   Authorize write-off of uncollectible utility accounts receivable and general accounts receivable incurred prior to July 1, 2015
 
18.   Authorize execution of License and Services Agreement and DocOrigin End User License Agreement with Tyler Technologies, Inc., in amount not-to-exceed $1,028,006 to provide software, hardware, data conversion, implementation, and training for Tyler's MUNIS Software Systems; authorize City Manager to execute optional items with Tyler not-to-exceed $173,725; authorize Three-party Master Depositor Escrow Service Agreement with Tyler and Iron Mountain Intellectual Property Management, Inc., in amount of $1,500; authorize Amendment No. 2 to Professional Services Agreement No. A2015-191 with NexLevel Information Technology, Inc. to increase amount not-to-exceed $400,000 to expand scope of work to include consulting services; authorize staff to solicit bids for purchase and installation of hardware not-to-exceed $8,300; and authorize termination of Agreement No. 92-11 with H.T.E. Sungard Public Sector in phased manner as replacement services come online
 
19.   Accept Public Disclosure Statements for Parks and Recreation Facilities, Existing Infrastructure, General City Facilities, Traffic Facilities, Storm Drain Facilities, Water Facilities, Sewer Facilities, Traffic Signal, Affordable Housing In-Lieu, and Development Impact In-Lieu Fees in General Fund; identify approximate date to commence construction of certain public improvements; and adopt schedule that Parkland (Quimby In-Lieu) Fee is committed to construction of Pinehurst Park
 
20.   Authorize execution of revised Mutual Aid Agreements with San Bernardino County Flood Control District and County of San Bernardino for services rendered for or by the City in event of an emergency
 
21.   Approve Amendment No. 2 to Agreement No. A12-05 with Michael Baker International, Inc., not-to-exceed amount of $273,632 to amend scope of work for additional structural engineering design analysis for Reservoir No. 18, and appropriations budget amendment in amount of $100,000 from Water Facilities Fee Fund balance to the Reservoir No. 18 project fund
 
22.   Accept Final Tract Map 18698 - Jade Tree Townhomes - KB Home Coastal, Inc., Applicant, for 65-unit multi-family residential townhome development located at northwest corner of Butterfield Ranch Road and Saint Gaudens Drive; execution of Subdivision Improvement Agreement; improvement securities; deposit of $3,500 to set monuments; and authorize the City Clerk to record Final Map

PLANNING COMMISSION MATTERS - This portion of the City Council Agenda is for matters from the December 6, 2016 Planning Commission Meeting. No action is required unless two members of the City Council wish to request a review of the matter, in accordance with Section 16.58.070 of the Chino Hills Municipal Code. Expiration of the public appeal period on Planning Commission Item No. 26 is December 20, 2016, 5:30 p.m.
 
26.   Amendment No. 1 to Site Plan Review No. 99SPR01 for the remodel of an existing McDonald's drive-through restaurant located at 15950 Los Serranos Country Club Drive within the Country Club Marketplace Shopping Center, based on findings of facts and subject to Conditions of Approval: Design UA, Applicant

27.   Adopt an Ordinance entitled: An Ordinance of the City Council of the City of Chino Hills, California, amending Chapter 15.04 of the City of Chino Hills Municipal Code by adopting by reference the 2016 Editions of the California Building Code Volumes 1 and 2, the California Plumbing Code, the California Mechanical Code, the California Electrical Code, the California Residential Code, the California Energy Code, and the California Green Building Standards Code with Appendices and Amendments thereto based on local conditions - Second Reading (Introduced November 22, 2016)
