Pursuant to Section 3 of Executive Order N-29-20, issued by Governor Newsom on March 17, 2020, the regular meeting of the City Council for April 28, 2020 will be conducted remotely through Zoom and broadcast live on the City's website.   Please be advised that pursuant to the Executive Order, and to ensure the health and safety of the public by limiting human contact that could spread the COVID-19 virus, the Council Chambers will not be open for the meeting.  Council Members will be participating remotely and will not be physically present in the Council Chambers.

CONSENT CALENDAR (6 ITEMS) - All matters listed on the Consent Calendar are considered routine by the City Council and may be enacted by one motion in the form listed below. There will be no separate discussion of these items unless, before the City Council votes on the motion to adopt, Members of the City Council or staff request the matter to be removed from the Consent Calendar for separate action. Removed consent items will be discussed immediately after the adoption of the balance of the Consent Calendar.
 
7.   Approve April 14, 2020 City Council Meeting Minutes
 
8.   Approve warrants and wires over $25,000 for period of April 2 through 15, 2020 in amount of $899,667.28
 
9.   Accept the Saddle Replacement - Phase 2 Project by T.E. Roberts, Inc., as complete, authorize City Clerk to record Notice of Completion, authorize release and retention monies in amount of $35,553.58, forty-five days after acceptance, and other related actions
 
10.   Award bid and contract to Onyx Paving Company, Inc., in amount of $437,000 for Mystic Canyon Drive Pavement Rehabilitation Project and authorize City Manager to approve cumulative change orders up to ten percent ($43,700) of awarded contract amount
 
11.   Award bid and contract to All American Asphalt in amount of $637,229 for Valle Vista Drive/Bayberry Drive Pavement Rehabilitation Project and authorize City Manager to approve cumulative change orders up to ten percent ($63,723) of awarded contract amount
 
12.   Adopt budget amendment resolution increasing FY 2019-20 Street Improvement Project in amount of $300,000, waive minor irregularity on bid and award contract to All American Asphalt in amount of $1,364,085.20 and authorize City Manager to approve cumulative change orders up to five percent ($68,204.26) of awarded contract amount

13.   Adopt resolutions adopting the Master Schedule of Fees, Fines and Penalties with proposed new fees, fee revisions, and increases effective July 1, 2020 and January 1, 2021, respectively and determine that the adoption of Fees, Fines and Penalties are exempt from review under the California Environmental Quality Act

14.   Appoint one student member to Parks and Recreation Commission with term expiring April 30, 2021
 
PLANNING COMMISSION MATTERS - This portion of the City Council Agenda is for matters from the April 21, 2020 Planning Commission Meeting. No action is required unless two members of the City Council wish to request a review of the matter, in accordance with Section 16.58.070 of the Chino Hills Municipal Code. Expiration of the public appeal period on Planning Commission Item(s) 5b, 7a, 7b, and 7c is May 5, 2020, 5:30 p.m.
 
15.   Custom Home Design Review No. 470 - Canon Lane, Freddy Martinez, Applicant: The Planning Commission adopted a Resolution approving Custom Home Design Review 470 for the development of a 1,304-square foot, two-story, single-family detached home with a 447-square foot, two-car garage and determining the project is exempt from review under the California Environmental Quality Act based on findings of fact and subject to Conditions of Approval
 
16.   Design Review No. 473, Minor Variance No. 20MNV01, and Tentative Parcel
Map 20037 - 4854 and 4858 Bird Farm Road, Umesh Patel, Applicant: The Planning Commission adopted a Resolution approving Design Review No. 473, Minor Variance No. 20MNV01, and Tentative Parcel Map 20037, for the Development of one single-family residence, increase the maximum allowed wall height, and two-lot subdivision and determining the project is exempt from review under the California Environmental Quality Act based on findings of fact and subject to Conditions of Approval
 
17.   Site Plan Review No. 15SPR04 and Conditional Use Permit No. 15CUP04 First Amendment, Minor Variance No. 18MNV01 and addendum to adopted Mitigated Negative Declaration - 14715 Peyton Drive, Father David Abdelsayed, representing Holy Transfiguration Coptic Orthodox Church (Coptic Church): The Planning Commission adopted a Resolution approving the first amendment to Site Plan Review No. 15SPR04, Conditional Use Permit No. 15CUP04, and Minor Variance No. 18MNV01, and adopting the findings in the addendum to the adopted Mitigated Negative Declaration for the modification of a religious institution development to add a total of 6,185 square feet of additional building based on findings of fact and subject to Conditions of Approval
 
18.   Extension of Time No. 20EXT01 for Tentative Tract Map 16414 - Northeast of Butterfield Ranch Road and Avenida De Portugal, Lennar, formerly CalAtlantic, Applicant: The Planning Commission adopted a Resolution approving Extension of Time 20EXT01 for Tentative Tract Map 16414 to subdivide 23.74 acres of vacant land to create 280 multi-family attached dwelling units and 5 acres of commercial (Vila Borba Planning Area 4) based on findings of fact and subject to Conditions of Approval
