This agenda contains a brief general description of each item to be considered. Except as otherwise provided by law, no action shall be taken on any item not appearing on the agenda unless the City Council makes a determination that an emergency exists or that a need to take immediate action on the item came to the attention of the City subsequent to the posting of the agenda. The City Clerk has on file copies of written documentation relating to each item of business on this Agenda available for public inspection in the Office of the City Clerk, in the public binder located at the entrance to the Council Chambers, and on the City's website at www.chinohills.org  while the meeting is in session. Materials related to an item on this Agenda submitted to the Council after distribution of the agenda packet are available for public inspection in the Office of the City Clerk at 14000 City Center Drive, Chino Hills, CA during normal business hours.

CONSENT CALENDAR (8 ITEMS) - All matters listed on the Consent Calendar are considered routine by the City Council and may be enacted by one motion in the form listed below. There will be no separate discussion of these items unless, before the City Council votes on the motion to adopt, Members of the City Council or staff request the matter to be removed from the Consent Calendar for separate action. Removed consent items will be discussed immediately after the adoption of the balance of the Consent Calendar.
 
9.   Approve February 27, 2018 City Council Meeting Minutes
 
10.   Approve Warrant Registers and Wires over $25,000 totaling $1,943,090.77 for period of February 15 through 28, 2018
 
11.   Receive and file City Official Reports pursuant to Travel, Training and Meetings Reimbursement Policy for period of February 14 through 27, 2018

14.   Adopt an Ordinance entitled: An Ordinance of the City Council of the City of Chino Hills, California, Amending the Chino Hills Municipal Code Title 12 (Streets Sidewalks, And Public Spaces) to Amend Section 12.32.120 (Smoking In City Owned Open Space) formerly 4.07.030 (Smoking) and Adding Section 12.40.380 (Smoking Prohibition) to Chapter 12.40 (Parks And Recreational Facilities) formerly Chapter 13.02 (Operational Policies) - Second Reading (Introduced February 27, 2018)
 
15.   Receive and file final Water and Recycled Water Rate Study and approve Proposition 218 Notice of Proposed Water Rate Increases and Protest Ballot containing the schedule of water rates being proposed for Fiscal Years 2018-19 through 2022-23
 
16.   Ratify action of City Manager to increase Purchase Order to Brithinee Electric by $71,500 for a total amount of $96,500; find that the emergency will not permit a delay resulting from competitive bidding; authorize City Manager to negotiate and execute a Public Works Agreement with Brithinee Electric to respond to the emergency and replacing the purchase order for an amount not-to-exceed $125,000 pursuant to Public Contract Code, § 22050 and the emergency authority under Chino Hills Municipal Code Section 3.18.050

17.   Provide direction for prioritization and allocation of Republic Services Community Organization Support Funding in the amount of $7,500
 
18.   Introduce and adopt by minimum of four/fifths vote an Urgency Ordinance entitled: An Ordinance of the City Council of the City of Chino Hills, California, Reauthorizing the Video Public, Educational, and Governmental Fee on State Video Franchisees Operating within the City of Chino Hills; and Introduce an Ordinance entitled: An Ordinance of the City Council of the City of Chino Hills, California, Reauthorizing the Video Public, Educational, and Governmental Fee on State Video Franchisees Operating within the City of Chino Hills, for first reading by title only - waive further reading
 
19.   Adopt resolution authorizing City Manager to submit a grant application for funding through Mobile Source Reduction Review Committee Clean Transportation Funding Program; authorize acceptance of award; approve appropriations budget amendment in the amount of $102,000 from City's Air Quality (AB 2766 Subvention) Fund; authorize City Manager to conduct all negotiations, and execution of all required documents; and issue purchase order in amount not-to exceed $82,000 for the purchase of two electric vehicles
 
PLANNING COMMISSION MATTERS - This portion of the City Council Agenda is for matters from the March 6, 2018, Planning Commission Meeting. No action is required unless two members of the City Council wish to request a review of the matter, in accordance with Section 16.58.070 of the Chino Hills Municipal Code. Expiration of the public appeal period on Planning Commission Item(s) 7b and 7c are March 20, 2018, 5:30 p.m.
 
20.   Site Plan Review No. 14SPR03 - 2563 Chino Hills Parkway, Jennifer Lovelace, of Sunny Hills Management Co., Inc., applicant: Adopted a Resolution approving Site Plan Review 14SPR03 First Amendment to allow for the modification of a previously approved anchor space remodel within the Gordon Ranch Marketplace to eliminate 18 tenant suites to accommodate a youth basketball training facility and Children’s Recreation area based on findings of fact and subject to Conditions of Approval
 
21.   Extension of Time No. 18EXT01 - Northeast of Butterfield Ranch Road and Avenida De Portugal, Cal Atlantic, applicant: Adopted a Resolution approving Extension of Time 18EXT01 for Tentative Tract Map 16414 to subdivide 23.74 acres of vacant land to create 280 Multi-Family attached dwelling units and 5-acre Commercial site (Vila Borba Planning Area 4) based on findings of fact and subject to Conditions of Approval
